Texas ADA case dismissed as NAFCU sits down with DOJ
A case against a Texas credit union over unclear website accessibility requirements under the Americans with Disabilities Act (ADA) was dismissed yesterday. NAFCU had submitted an amicus brief in the case.
Another case in Texas was also dismissed involving the same plaintiff.
More than a hundred credit unions in 24 states have received demand letters over alleged ADA violations. NAFCU and its members strongly support the protections of the ADA and efforts to ensure individuals with disabilities are not discriminated against and have equal access to financial services. However, the association believes this is best achieved through clear guidance and standards for website compliance, not through meritless and costly lawsuits.
On Thursday, NAFCU senior staff met with the Department of Justice's (DOJ) Disability Rights Section to discuss solutions to fix the current regulatory void related to standards for website accessibility for entities like credit unions.
Two other credit unions have seen cases dismissed against them on this issue as well.
